Caterpillar is seeking an attorney to provide legal support throughout the company and to all business units on data privacy related matters and become a valuable member of the Caterpillar Data Center of Excellence ("Data COE").

 

The role will provide management, leadership and legal expertise on data privacy issues; privacy compliance matters, conduct risk assessments, provide counsel to business leaders and other members of the legal department; and identify and contribute to resolution of privacy related legal issues with a broad and complex band of risk exposure. This role will review and negotiate privacy terms with clients and vendors, provide advice on global privacy laws and regulations, create and present training, review and revise policies, notices and other materials related to Caterpillar's privacy practices and processes. The Privacy Counsel will work closely with other members of the Caterpillar Data COE and collaborate with relevant functional and regional legal teams to ensure the provision of responsive and high-quality legal support globally.

 

This role will also provide specific data privacy support in the financial services field including advice for data privacy compliance in the development and utilization of financial systems, notices and processes that play a role in data gathering from companies, small proprietorships and individuals (e.g. Guarantors) during the course of originating, managing and collecting on financial arrangements offered to Caterpillar customers. It will also work with business teams on the development of processes for accepting, storing and tracking personal data in compliance with legal requirements and company policies including advice on application and core document notices and consents and the requirements for tracking opt ins and opt outs. The incumbent will provide "privacy by design" advice for the development of systems and processes that obtain and handle personal information during the course of originating, managing and collecting on financial arrangements offered to Caterpillar customers.

 

In addition, the incumbent will provide counsel on intra-company data sharing in the marketing context as well as advice on the use of data for invoicing systems and payment due reminders across a number of tools, apps and email platforms across Caterpillar. Familiarity with of GDPR, national privacy laws (including Brazil, China, Australia, Canada and major EU jurisdictions) US state law requirements and ongoing legislative efforts in data privacy would be required as well as familiarity with current vaulting laws and developments in that area. In addition to data privacy laws worldwide, laws that are implicated include the Fair Credit Reporting Act, Equal Credit Opportunity Act and U.S. state law requirements.
