J&J is seeking an experienced, collaborative attorney to join our Legal Department as Senior Counsel, Privacy Law.  The successful candidate will be responsible for advising on data protection and privacy laws and regulations affecting business activities across our three sectors (Pharmaceuticals, Medical Devices, and Consumer) primarily in the United States and Canada.  The candidate will work closely with other Privacy/ Regulatory lawyers and with Global Privacy colleagues to provide counsel on privacy related matters, including developing and reviewing related policies, practices, and training as required, in support of ongoing or proposed business activities, and in the development of new products, programs, and technologies.  The candidate will be expected to perform duties with minimal supervision, and sound judgment and professional discretion.   The candidate is expected to remain current with developments and trends in privacy laws and regulations having impact for the US and Canadian businesses.  This position is based at J&J World Headquarters, New Brunswick, NJ.

  • Provide strategic direction to the J&J Companies regarding existing and privacy and data protection laws in the United States and Canada. Counsel on proposed business arrangements and develop innovative approaches and creative solutions to compliantly enable the business operations.
  • Support consistent, effective data privacy practices, to minimize privacy risk and to ensure the confidentiality of personal data. Develop and implement training to foster awareness of data privacy requirements.  Counsel on privacy risk assessments, when required, and on the practical mitigation of privacy risk.
  • Support the investigations of incidents involving the inappropriate or unauthorized access, loss, modification or disclosure of personal data. 
  • Develop and implement strategies to shape the external privacy landscape to enable the company to advance its mission in support of the research and development of innovative medicines and personalized health care and related programs.
  • Work collaboratively with Company’s Chief Privacy Officer, Global Privacy colleagues, Law Department colleagues, and other leaders across the J&J Companies to assure coordination of efforts, to share knowledge, and to share best practices relating to data protection and privacy.
  • Collaborate with privacy lawyer(s) and cybersecurity lawyer to counsel Johnson & Johnson Technology (JJT) with respect to privacy issues in data handling and processing activities.
  • Supporting Privacy By Design initiatives within the US and Canada.
  • Collaborate with business partners and contracting teams to counsel on and address data privacy issues in contractual arrangements with third parties.

  • A JD degree and U.S. state bar membership in good standing are required. 
  • 7-10 years of experience as a practicing attorney, in-house and/or at a law firm, including at least seven years of direct, hands-on experience providing legal counseling on data protection and privacy issues to pharmaceutical, medical devices, and/or health-related consumer companies is required.  
  • Experience assessing legal risks relating to data privacy and data protection requirements in the US and Canada, and in identifying and advising on practical, compliant ways to mitigate such risks, with minimal supervision is required.
  • Experience working with senior-level stakeholders and cross-functional teams, and achieving results through influence and collaboration is required.
  • Ability to work effectively in large, matrixed organizations.
  • Ability to demonstrate sound judgment and professional demeanor and discretion.
  • Comprehensive understanding of relevant statutes, regulations and guidance is required, such as the California Consumer Privacy Act and other state privacy laws and breach notification requirements; HIPAA; consumer protection laws like TCPA, COPPA, and CAN-SPAM, Canada’s PIPEDA (including meaningful consent), and provincial data protection and data privacy laws, as well as working knowledge of major global and industry data protection and data privacy standards, such as GDPR and ISO required.
  • Strong analytical, communication and legal writing skills.
  • Minimum CIPP-US certification is highly preferred.
  • Estimated 10% travel may be required.
